Terms of Service

The agreement between you and SwingAlerts for using SwingAlerts. The short version: we watch the market and tell you when your conditions are met, we try hard to be on time, and none of it is advice or a promise.
What SwingAlerts is
You write rules describing conditions on a ticker. We evaluate them against market data as it arrives and notify you when a rule fires. That is the whole of what is on offer.
By using it you agree to these terms. If you do not, do not use it.
Signing up
Anyone can sign up. Every new account starts on the Free membership, and paying for Paid is optional. We may still refuse or close an account as these terms describe, and we may stop offering the service entirely while it is at this early stage.
This is not investment advice
SwingAlerts is a monitoring tool. An alert is a statement that conditions you chose were met on data we received. It is not a recommendation to buy, sell or hold anything, it is not a prediction, it is not a signal service, and it is not personalised advice of any kind. We do not know your circumstances, your objectives or your risk tolerance, and we are not regulated to advise you on any of them.
Trading forex and other leveraged instruments carries substantial risk and can cost you more than you put in. Past behaviour of an indicator says nothing about its future behaviour. Every decision you take after receiving an alert is yours alone, and so is every outcome of it. If you need advice, get it from someone licensed to give it.
Alerts are best-effort, not guaranteed
We would rather be blunt about this than bury it, because a trading tool that implies reliability it does not have is dangerous.
We do not guarantee that an alert will be delivered, that it will arrive promptly, or that it will arrive at all. Specifically and by design:
- Market data reaches us from a third party over a live connection. If that connection drops, data is delayed, or the provider has a fault, rules are not evaluated on data we never received — and a condition that was met during that window may never fire.
- Forex markets close. While they are closed nothing is evaluated, and the app will correctly show the feed as offline.
- Delivery depends on email or Telegram, and on your own provider, filters, inbox and Telegram account.
- Your own settings suppress alerts on purpose: quiet hours hold delivery, a minimum gap and a per-rule cooldown drop alerts that fall too close together, and switching a channel off in Settings overrides what a rule asked for.
- A rule that has fired and is not set to re-arm stops being evaluated until you reset it.
Market data
Prices come from a third-party provider and are passed to you as received. We do not originate, verify or correct them. They may be delayed, incomplete, inaccurate or unavailable, and they will not always match your broker’s. Do not treat a price in an alert as a price you can trade at.
Market data is licensed to us, not to you. You may use it inside SwingAlerts. You may not redistribute it, resell it, or extract it in bulk to build a dataset or another product.
Your account
Keep your sign-in credentials to yourself, and do not share your account. Tell us at alerts@swingalerts.app if you think someone else has got into it. What happens through your account is your responsibility.
Your rules are yours. We claim no ownership of them, and we do not use them to trade or hand them to anyone else. We need permission to store and process them only so far as running the service requires, and that permission ends when you delete them.
Limits
Each account holds a Free or a Paid membership, and the only difference between them is how many rules can be active at once: 3 on Free, 100 on Paid. Disabled rules do not count, so archiving a rule by disabling it is always allowed. Replay requests are capped at 5,000 bars. These are operational limits and we may change them; lowering one never disables a rule you already have active.
Paid membership
Paid is a subscription, billed monthly or annually at the price shown at checkout, with no free trial. It renews automatically at the end of each period until it is cancelled.
Paid is sold by Link, Stripe’s payment service, as merchant of record. Link takes the payment, charges any tax or VAT due where you live, issues your receipts, and appears on your statement as LINK.COM. Your purchase is also subject to Link’s own terms.
You can cancel from Settings at any time. Paid then lasts until the end of the period you have paid for and does not renew, and you can change your mind before then. Cancelling on link.com has the same effect. We do not refund the unused part of a period, and a refund Link grants does not by itself end your subscription.
If a renewal payment fails, Paid continues while the payment is retried. If it cannot be collected, the subscription ends.
When Paid ends, for whatever reason, your account becomes Free. If you then have more than 3 active rules, every active rule is disabled, not just enough to get under the limit, because we will not guess which ones matter to you. With 3 or fewer, nothing is disabled. Your rules and their alert history are kept either way, and we email you when it happens. You can re-enable up to 3 rules, or upgrade again and re-enable the rest.
Closing a Paid account cancels the subscription immediately, with no refund for the rest of the period.
Nothing here limits any right you have under consumer protection law.
What you must not do
Do not:
- Resell, sublicense or redistribute the service or the market data in it.
- Automate access beyond your own ordinary use, or evade the limits above.
- Probe, scrape, overload or interfere with the service or anyone else’s use of it.
- Use SwingAlerts to break the law, to manipulate a market, or to provide regulated financial advice to other people.
- Attempt to reach another account’s rules, alerts or data.
Suspension and closure
We may suspend or close an account that breaks these terms, or that puts the service or another person at risk. We will tell you why where we reasonably can.
You may close your account at any time. Doing so cancels any Paid subscription immediately and deletes your rules and their alert history permanently, as the Privacy Policy describes.
No warranty
SwingAlerts is provided as it is and as it is available, with no warranty of any kind. We do not warrant that it will be uninterrupted, timely, secure, error-free, or that any alert will be accurate or delivered. It is early software and it should be treated as such.
Limitation of liability
To the fullest extent the law allows, we are not liable for trading losses, lost profits, lost opportunities, or any indirect or consequential loss arising from your use of SwingAlerts — including from an alert that was late, wrong, duplicated, suppressed or never sent at all.
Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.
Changes
We may change the service, and we may change these terms. If a change materially affects you we will email you before it takes effect. Continuing to use SwingAlerts afterwards means you accept the new terms.
Governing law
These terms are governed by the law of Spain, and its courts hear any dispute arising from them.
